First Anniversary Of Circuit Court Decision Against Oneida Seven Generations Corporation [UPDATE]

Today marks one year since Brown County Judge Marc A. Hammer ruled that the Common Council of the City of Green Bay acted within its rights when it revoked the Conditional Use Permit granted to Oneida Seven Generations Corporation due to several misrepresentations OSGC made to the public and elected officials regarding its waste incinerator proposals.

It was for that reason, among others, that the Oneida General Tribal Council voted on May 5, 2013 to direct the Oneida Business Committee to forbid OSGC from building or operating any kind of incinerator on the Oneida reservation.

Despite GTC making its objections to incinerators on the Oneida reservation known, OSGC nevertheless allowed another company to use its property at 1201 O’Hare Boulevard, Hobart, WI, on the Oneida reservation for open flame waste incineration.

It was for that reason, among others, that General Tribal Council voted on December 15, 2013 to direct the Business Committee to dissolve OSGC.

OSGC appealed the January 9, 2013 Brown County Court decision and is currently awaiting an opinion/ decision by the Wisconsin State Court of Appeals.

It is not expected that OSGC will be successful in its appeal, but the actions by General Tribal Council make the issue irrelevant.

General Tribal Council – as the supreme governing body of the Oneida Tribe of Indians of Wisconsin – has spoken:

Oneida Seven Generations Corporation must be dissolved.

Any Oneida Tribal politician, official or member who seeks to subvert or attempts to undermine GTC’s decision to dissolve OSGC should fully anticipate having their derrière delivered back to them.

 

UPDATE: The Annual GTC Meeting postponed from January 6, 2014 has been rescheduled for 1 p.m. Sunday February 16, 2014.

The Business Committee also chose 10 a.m. Saturday March 22, 2014 to schedule Tribal Chair Ed Delgado’s demanded Special GTC Meeting to “reconsider GTC’s December 15, 2013 vote to dissolve OSGC, and the March 22 GTC Meeting will address Loretta Metoxen’s petition which also seeks to undo GTC’s vote to dissolve OSGC.

Interestingly, it’s possible that an Election Caucus could be held at the 10 a.m. Saturday March 22, 2014 Special GTC Meeting, which would provide a perfect opportunity for GTC to formally present Tribal politicians their own backsides.
[NOTE: Page 2A of the January 9, 2014 edition of the Kalihwisaks lists the wrong date for the Special GTC meeting and instead lists the date for the rescheduled Annual Meeting. Also, the Kalihwisaks 2013 news round-up entirely omits GTC’s May 5, 2013 vote to prohibit OSGC from building, operating or providing commercial space for incinerators on the Oneida reservation. Maybe the Kali staff wants to forget it happened, or they just want GTC to forget about it.]
