Oneida Appeals Commission’s Trial Body Lifts Stay Of Illegal Election

Both the October 26, 2014, GTC Meeting Action Report and the video of the GTC Meeting show that GTC did not vote to adopt a motion to hold an election to address the OBC vacancy, so the caucus held on October 26, 2014, was illegal as was the unlawfully scheduled election, and no caucus nor election should be held unless GTC formally enacts either in accordance with Article III of the Tribal Constitution.

The Trial Body failed to require that any election to address the OBC vacancy be lawfully mandated by GTC and be legally conducted in accordance with the Oneida Election Law, and now they claim that GTC may overrule Tribal laws by a simple majority vote.

The Petitioners will appeal the Trial Body’s Decision which is just the latest exhibit in the evidence pile displaying that the Oneida Tribe of Indians of Wisconsin is incapable of establishing or maintaining a court of competent jurisdiction free from bias and nepotism.
