[UPDATE: Nobody showed up in defense of Paul Ninham. At 8:50 a.m. Judge Zuidmulder stated he had not received any response to Oneida Small Business, Inc.’s Motion for Summary Judgment from any representative for Paul nor Duck Creek Coffee, Co., LLC, and so he issued a Summary Judgment for Oneida Small Business, Inc.]
Looking for something to do on Thursday morning March 20, 2014?
Head on down to the Brown County Courthouse, 2nd Floor, Room 260 at 9:00 a.m. to listen to the Oral Arguments in Brown Co. Case No. 2013CV1835, Oneida Small Business Inc. vs. Duck Creek Coffee Co., LLC, Paul Ninham & Jill Martus-Ninham.
Here are public documents in Brown Co. Case No. 2013CV1835: Complaint; Answer; Plaintiff’s Brief in Support of Motion for Summary Judgment; Affidavit in Support of Motion for Summary Judgment
The November 13, 2013 Complaint states:
Defendants, Paul K. Ninham and Jill Martus-Ninham, as Members of and on behalf of Defendant, Duck Creek Coffee Co., LLC, on or around August 7, 2008, exectuted a Business Note wherein Defendants borrowed money from the Plaintiff subject to the terms and conditions set forth in said note. The principal amount borrowed by the Defendants was $70,000.00.
…Defendants are in breach of the Business Note for failure to make payments as required by the terms of the Note and are therefore in default on the loan.
As of August 22, 2013, the sum of $77,207.09 is due and owing to Plaintiff, Oneida Small Business[, Inc.] per the terms of the Business Note.
Maybe this explains the reason why Business Committee member Paul Ninham’s feathers were so easily ruffled and he shouted an obscenity from the dais at the March 12, 2014 BC Regular Meeting. (Temper, temper, Paul.)
In any case, Paul Ninham isn’t the only member of the Oneida Business Committee to have defaulted on a business loan from Oneida Small Business, Inc.
More tomorrow.
