Below is the Complaint in Brown Co. Case No. 13CV1879, Oneida Small Business, Inc. vs. Leslie D. Cornette d/b/a KC’s Lawn Cutting Services:

Defendant, Leslie D. Cornette, d/b/a KC’s Lawn Cutting Services, on or around May 2, 2008, executed a Business Note wherein Defendant borrowed money from the Plaintiff subject to the terms and conditions set forth in said note. The principal amount borrowed by the Defendant was $30,000.00.

…As of August 22, 2013, the sum of $35,985.56 is due and owing to Plaintiff, Oneida Small Business per the terms of the Business Note.

Below is the Complaint in Brown Co. Case No. 13CV1888, Oneida Small Business, Inc. vs. Tamar J. Cornelius & Jorge E. Soto-Colon d/b/a Gali’s Restaurant:

Defendants, Tamar J. Cornelius and Jorge E. Soto-Colon, d/b/a Gali’s Restaurant, on or around October 28, 2008, executed a Business Note refinancing previous Notes wherein Defendants borrowed money from the Plaintiff subject to the terms and conditions set forth in said note. The principal amount borrowed by the Defendants was $100,000.00.

…As of August 22, 2013, the sum of $117,887.30 is due and owing to Plaintiff, Oneida Small Business per the terms of the Business Note.

Tamar Cornelius is the daughter of former Oneida Tribal Treasurer Judy Cornelius, and as Oneida Eye reported yesterday, WI Dept. of Financial Information records show that on May 5, 2012 the Registered Agent of Oneida Small Business, Inc. was changed to Oneida Tribe member Dan Hawk / Daniel D. Hawk, who is Judy Cornelius’ husband and Tamar Cornelius’ step-father. Gali’s Restaurant opened in the same location that Judy Cornelius’ failed Dragonfly Bookstore previously occupied.

Robert Yuma Thomas is the son of Oneida Appellate Court Judge Winifred McLester-Thomas who is the sister of Judy McLester-Cornelius, making Yuma Thomas the nephew of Judy Cornelius.

  • August 1999 – August 2000:   Judy Cornelius was Oneida Tribal Treasurer, current Treas. Tina Danforth was BC Chair, and current Business Committee member Paul Ninham was a BC member.
  • May 16, 2003:   Summons and Complaint filed by Jorge Gomez against Dan Hawk and Native American Insurance Co., Inc., in Dane Co. Case No. 03CV1487.
  • July 28, 2003:   In Dane Co. Case No. 03CV1487, Court denied Defendant Dan Hawk‘s Motion to Dismiss; Court found Dan Hawk in contempt; Court ordered Dan Hawk to cease & desist from soliciting in Native American Insurance Co., Inc., or any other business that does not have organization permit, including any solicitations via website NativeAmericanMutual.com; Dan Hawk ordered to provide written confirmation that solicitation has ceased; if Dan Hawk fails to comply with this court order, Court will authorize issuance of a bench warrant or body attachment, and Dan Hawk shall remain in custody until compliance.
  • July 30, 2003:   In Dane Co. Case No. 03CV1487, Court denies Defendant Dan Hawk‘s motion to dismiss and grants Plaintiff Gomez’s Contempt Petition; Defendant Dan Hawk ordered to comply within 15 days or bench warrant and/or body attachment shall issue.
  • December 2, 2003:   Court orders Dan Hawk to have no contact with Oneida Nations Farm except for legal matters.
  • January 6, 2004:   Oneida Small Business, Inc. is registered with WDFI.org.
  • November 16, 2004:   Dan Hawk Found Guilty at Jury Trial of Felony C Theft-Moveable Propery >$2500; Sentence: 4 years Jail; Sentence held, Probation; Restitution ordered in the amount of $22,286.37.
  • August 18, 2006:   White Eagle Sports Bar & Grill, LLC, signed a General Business Security Agreement pledging business assets as collateral for a $48,925.16 Business Note with Oneida Small Business, Inc.; Paul & Tina Danforth signed a Continuing Guaranty (Unlimited), personally guaranteeing the loans of White Eagle Sports Bar & Grill, LLC.
  • August 7, 2008:   Current Oneida Business Committee member Paul Ninham and wife Jill Martus-Ninham borrow $70,000.00 from Oneida Small Business, Inc. to open Duck Creek Coffee, Co.
  • November 9, 2009:   According to page 1 of WI Dept. of Commerce Contract #LEG FY10-19812: “WHEREAS, 2009 Wisconsin Act 28 authorizes the Department to make an annual grant of $1,000,000.00 in each of the year 2009- 11 biennium to Oneida Seven Generations Corporation from funds encumbered in the appropriation under section 20.143 (kj) in the statutes of previous years but not disbursed for grants to Oneida Small Business Inc. and Project 2000 from the gaming economic diversification grant and loan program.” (2009–2011 WI Dept. of Commerce disbursed $2,000,000.00 to OSGC.)
  • March 16, 2010:   WDFI.org records show that Oneida Small Business, Inc., was ‘Administratively Dissolved.’
  • May 20, 2011:   Judgment for Portfolio Recovery Associates, LLC, against Dan Hawk in the amount of $10,621.51 in Brown Co. Case. No. 10CV1153
  • May 23, 2011:  WDFI.org records that that Oneida Small Business, Inc., was ‘Restored to Good Standing’ and that there was a ‘Change of Registered Agent.’
  • July 27, 2011: Bay Bank issues Summons and Complaint against White Eagle Sports Bar & Grill, LLC, Paul Danforth, and Tina Danforth in a ‘Debt Action’ in Brown Co. Case No. 2011CV1752.
  • May 24, 2012:  WDFI.org records show that Oneida Small Business, Inc., had another ‘Change of Registered Agent’ which seems to have been Dan Hawk, who was at that time and is currently married to Judy Cornelius.
  • November 14, 2013:  Oneida Small Business, Inc., issues Summons and Complaint in a ‘Debt Action’ against Robert Yuma Thomas in Brown Co. Case No. 13CV1826.
  • November 15, 2013:  Oneida Small Business, Inc., issues Summons and Complaint in a ‘Debt Action’ against White Eagle Sports Bar & Grill, LLC, Paul Danforth and Tina Danforth in Brown Co. Case No. 13CV1838.
  • November 15, 2013:  Oneida Small Business, Inc., issues Summons and Complaint in a ‘Debt Action’ against Paul Ninham, Jill Martus-Ninham, and Duck Creek Coffee Co., LLC, in Brown Co. Case No. 13CV1835.

  • February 26, 2014: Oneida Small Business, Inc., and Scott & Colleen Cottrell stipulate and agree to the dismissal of action in Brown Co. Case No. 13CV1836 upon condition of the Cottrell’s willingness to pay Oneida Small Business, Inc., $116,032.86.
  • March 20, 2014:  Oral arguments begin in Brown Co. Case No. 13CV1835Oneida Small Business, Inc., vs. Paul Ninham, Jill, Martus-Ninham and Duck Creek Coffee Co., LLC.

 

By the way, Dan Hawk‘s mother, Arletta ‘Cookie’ Hawk-Kurowski, is the sister of Amelia Hawk-Cornelius, who is a former Oneida Gaming Commission Vice-Chair and currently the Oneida Land Commission Chair as well as the mother of the former CEO of Oneida Seven Generations Corp. and Chair & CEO of Green Bay Renewable Energy, …the infamous Kevin Cornelius.

  4. What role did Bay Bank play in the selection of loan recipients and efforts to collect overdue loans made by Oneida Small Business, Inc.?
  5. How was the decision made, and who in the Oneida Tribe requested, that $2,000,000.00 in loan funds from Wisconsin Act 28 §20.143 (kj) be directed to Oneida Seven Generations Corp.?
